1. SCOPE OF APPLICATION

The following terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively for consumers.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in exercise of his commercial or independent professional activity.


2. CONTRACTUAL PARTNER, CONCLUSION OF CONTRACT, CORRECTION OPTIONS

The purchase contract is concluded with Metallbude SK GmbH.

By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded by you accepting the offer for the goods contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive a confirmation by email again.


3.CONTRACT LANGUAGE, CONTRACT TEXT STORAGE

The language(s) available for the conclusion of the contract: German, French, Spanish, English

We store the contract text and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.


4. DELIVERY CONDITIONS

In addition to the stated product prices, shipping costs may also apply. More detailed provisions on any applicable shipping costs can be found in the offers.

We deliver by shipping. Self-collection of the goods is possible.

We do not deliver to packing stations.


5.PAYMENT

In our shop, the following payment methods are generally available:

Prepayment
If you choose the prepayment method, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

Credit Card
When you place your order, you provide your credit card details. After your authentication as the legitimate cardholder, the payment transaction is automatically carried out and your card is charged.

PayPal, PayPal Express
During the ordering process, you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there orFirst, you need to register, authenticate with your access data, and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction. The payment transaction is automatically carried out by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Sofort by Klarna
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to pay the invoice amount via Sofort, you must have a bank account activated for online banking, authenticate accordingly, and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction is carried out immediately afterwards by Sofort and your account is debited.

Giropay
After placing the order, you will be redirected to your bank's website. In order to pay the invoice amount via Giropay, you must have a bank account activated for online banking, authenticate yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction is carried out immediately afterwards and your account is debited.

Apple Pay
In order to pay the invoice amount via Apple Pay, you must use the "Safari" browser, be registered with the service provider Apple, have activated the Apple Pay function, authenticate yourself with your access data and confirm the payment order. The payment transaction is carried out immediately after placing the order.You will receive further instructions during the ordering process.

Google Pay
In order to pay the invoice amount via Google Pay, you must be registered with the service provider Google, have activated the Google Pay function, authenticate yourself with your access data and confirm the payment order. The payment transaction is carried out immediately after the order is placed. You will receive further instructions during the ordering process.


6. RETENTION OF TITLE

The goods remain our property until full payment is made.


7. TRANSPORT DAMAGES

If goods are delivered with obvious transport damage, please report such errors as soon as possible to the deliverer and please contact us immediately.The failure to make a complaint or establish contact has no consequences for your statutory claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.


8. WARRANTY AND GUARANTEES

Unless expressly agreed otherwise below, the statutory liability for defects applies.
For used goods, the following applies: if the defect occurs after one year from delivery of the goods, the claims for defects are excluded. Defects that occur within one year from delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
The above limitations and shortened deadlines do not apply to claims due to damages caused by us, our legal representatives or vicarious agents
• in case of injury to life, body or health
• in case of intentional or grossly negligent breach of duty as well as deceit
• in case of breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, as far as agreed or
• as far as the scope of the Product Liability Act is opened.

9.LIABILITY

We are always fully liable for claims due to damages caused by us, our legal representatives or vicarious agents
• in case of injury to life, body or health
• in case of intentional or grossly negligent breach of duty
• in case of guarantee promises, as far as agreed, or
• as far as the scope of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, the liability is limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
Furthermore, claims for damages are excluded.


10. DISPUTE RESOLUTION

The European Commission provides a platform for online dispute resolution (OS). We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.

11. UNIQUE IDENTIFICATION NUMBER (UIN) / EXTENDED PRODUCER RESPONSIBILITY (EPR)

As part of the Extended Producer Responsibility (EPR) in France, we are obliged to use a Unique Identification Number (UIN) to ensure the traceability and disposal of our products. Our Unique Identification Number (UIN) is: FR401156_01FCHI. This number serves to uniquely identify our products and is used in all relevant documentation and reports related to the EPR. Our customers are obliged to ensure that the UIN is properly passed on and used when reselling or returning the products, to ensure compliance with the EPR guidelines.
